This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips and software, is the property of Edo Performance or its suppliers and protected by U.S. and international copyright laws. All trademarks, service marks, and trade names are proprietary to Edo Performance. All other trademarks not owned by Edo Performance or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Edo Performance. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. All software used on this site is the property Edo Performance or its software suppliers and protected by U.S. and international copyright laws and may not be reproduced, modified, distributed, transmitted, or republished.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information/pictures received from the suppliers or manufacturers, Edo Performance reserves the right to refuse or cancel any order(s) placed for product listed at the incorrect price. If your credit card has already been charged for the purchase and your order is canceled, Edo Performance shall immediately issue a credit to your credit card account in the amount of the charge.

Ordering Procedure:

Your receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Edo Performance reserves the right at any time after receipt of your order to accept or decline your order for any reason. Edo Performance may require additional verifications or information before accepting any order. Once you have placed an online, phone order, or other type of order with Edo Performance, you have entered in a contract to purchase and your credit card will be charged immediately. Orders DO NOT always ship the same day. Actual shipping time is contingent upon availability of merchandise and credit verification. Please allow 24 hours for your order to ship.  If you need priority delivery then please contact us by phone for immediate attention. 

The import market is currently one of the hottest cars right now on the market. Parts turnover is quick. So when you order from Edo Performance, we put you in line to receive the product if it is not in stock. Some specialty items may need to be ordered from overseas and can take 4-12 weeks for delivery.

When you order a product, your credit card is charged immediately as stated above and as agreed. We will notify you the status of the order and the product availability. If you choose to cancel the order after the order has been processed, a 5% cancellation fee will be charged and the remaining amount will be credited back to you.

Shipping:
All orders are processed upon receipt. Actual shipping time is contingent upon availability of merchandise and credit verification. Most orders are shipped within 1 business day of receiving the order. Purchases are shipped via UPS Ground Services or Fedex Ground unless otherwise specified. Any international shipment and expedited shipment requires additional shipping fee. Please contact us for shipping quote before purchasing. Orders are also processed or shipped on Saturdays or Sundays. Signature is required on all orders. (There must be someone to sign for the package or you have to pick it up from the local UPS or Fedex station.)
Return Policy:

We accept returned items in new or like new condition within 15 days of invoice date accompanied by the proper invoice. However, there is a 25% restocking fee for all returned items. There is no return or exchange policy on any special priced products. Parts that have already been installed cannot be returned at our discretion.

If you wish to return a product for any reason you must call us at 714-602-5741 prior to sending your package back and we will provide you with a Return Merchandise Authorization (RMA) form. Once the return authorization form has been faxed back, you will be supplied with an RMA#. This RMA# should be clearly visible on the outside of the box. This enables our shipping department to identify your package so we can expedite any credit you may have coming. Any package shipped to us without this RMA# will NOT be accepted.

Damages / Loss of Package during delivery:

We inspect every product before shipping, and insure that all packages are properly protected with tape, bubble wrap, foam, etc. All products shipped is fully insured with the product(s) invoiced value. Customers are provided with a tracking number for the shipment once the products have been shipped.

We advise you to inspect your products at the presence of the shipper. All damage claims must be reported to the shipping carrier, but we will assist you the best we can. EDO Performance is NOT responsible for the outcome of the claims.

In the rare case of lost shipment, Customer must make the necessary claim with the shipping carrier. Again, we will provide you with the best assistance possible. Replacement products will not be sent out until the claim is settled with the said shipping carrier.

Cancellation Policy:
Cancellation of ordered item shipped via ground service must be requested within 1 week of order. The cancellation of ordered item will be subject to a 5% cancellation fee of total invoice. Cancellation of ordered items shipped via expedited service must be requested within 24 hours of placed order. The cancellation of ordered item will be subject to a 5% cancellation fee of total invoice. All international and phone orders are non-cancelable.
Payment Terms:
Edo Performance accepts credit cards, Paypal payments and Bank Transfers with appropriate billing and shipping addresses to be verified.  All orders are to be paid in full at the time of purchase unless we contact you otherwise. Prices and shipping cost is subject to change anytime because of exchange rates, shipping costs, manufacturer price changes, etc.
Warranty:

All products come with the warranty that is applied directly by the manufacturer. Edo Performance DOES NOT offer any of our own warranties and are not responsible for product failures or failures due to installation. All products are intended for race use only as suggested by the manufacturers and should be installed and set up by professional service centers ONLY. Edo Performance is not responsible for shipping cost other than by our own mistake of incorrect shipping.

If you wish to return a product for a manufacturer's warranty you must first contact us at 714-602-5741 and get an RMA (Return Merchandise Authorization) number. You must then ship it back to us at Edo Performance, 11922 Western Ave, Garden Grove, CA 90680. This shipping will not be paid by Edo Performance. Once we receive the product, we will ship it to the manufacturer. The warranty process of your product can take from 2 weeks to 3 months depending on the manufacturer. If the manufacturer approves the claim, it is up to their sole discretion (or provided manufacturer's warranty coverage) if the product will be repaired, replaced or if a full refund will be provided. If you cannot wait for the warranty process to be completed and need a replacement part immediately, you may at any time purchase a replacement product from us. We will NOT ship a replacement part unless payment for the part is collected or a credit from the manufacturer has been received.

Privacy Policy:

EDO Performance values your privacy and only collects the minimum information needed to succesfully process your order. None of this information is shared with third parties. To protect your information while shopping at EDO Performance we offer a fully secure encrypted shopping cart and account management center.

We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site, including this Agreement, without further notice to users of the Site.
